Who we are
Merriment Labs is the name under which Jesse Johnston, an individual developer, publishes apps. In these terms, “we” and “us” mean Jesse Johnston. “The apps” means Roastbook, Ducky, and any other app published under the Merriment Labs name.
Using the apps and this site
You may use the apps and this website for your own personal purposes. Please don’t use them to break the law, interfere with other people, or attempt to disrupt this website or the contact form.
Ducky is a timer, and we have worked hard to make its alarms reliable. Still, phones run out of battery, get muted, and restart. Don’t rely on any app, ours included, where a missed alarm could cause harm to people or property.
Your content
Your photos, notes, ratings, and settings are yours. They stay on your device (see each app’s privacy policy), and we claim no rights to them. You are responsible for keeping backups of anything you care about; the apps offer tools to help.
Third-party services
Some optional features connect you to services run by others, such as Google’s Gemini API when you add your own key to Roastbook, or a cloud storage provider you choose for backups. Your use of those services is governed by their terms, and any costs they charge under your account are yours. Information an app suggests from those services (a roaster’s website, for example) may be wrong, so treat it as a starting point.
Open source
Where we publish an app’s source code, that code is licensed under the license included with it (Roastbook is planned for release under the Apache License 2.0). That license governs your use of the source code. These terms cover the apps as we distribute them and this website.
No warranty
The apps and this website are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent the law allows.
Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the apps or this website. Our total liability for any claim relating to them is limited to the amount you paid us for the app in the twelve months before the claim, if any. Some places do not allow these limits, so they may not apply to you.
Changes
We may update these terms as the apps change. The date at the top will change when we do, and continued use after an update means you accept the new terms.
